Benefits of Patent Ownership

            The inventor(s) listed on the patent application or the assignees of the patent are the vested owners of the patent. This ownership gives the patent holder the “right to exclude others from making, using, offering for sale, selling, or importing into the United States the invention claimed in the patent.”  However, simply because a patent was awarded does not mean that there is an absolute right to sell, make, or distribute what the patent protects.  There may be other legal considerations, such as whether there is a dominate patent or an existing injunction, that affect the owner’s ability to practice the patented invention.
